Terms of service

These terms and conditions apply to all consumer orders in the Bohemida online shop.

Article 1. Identity of the trader

Article 2. Definitions

Consumer: the natural person who is not acting in the exercise of a profession or business.
Distance contract: a contract concluded through the online shop, without the consumer and the trader being in the same place at the same time.
Cooling off period: the period within which the consumer can exercise the right of withdrawal.
Day: calendar day.

Article 3. Applicability

These terms apply to every offer from Bohemida and to every distance contract with a consumer. The text is available on the website before the contract is concluded and can be saved. If a provision is void or annulled, the other provisions remain in force. For business customers, such as wholesale, private label and custom work, the agreements made in writing apply.

Article 4. The offer

The offer contains as complete and accurate a description of the products as possible. The products are handmade. That makes every item unique, and small differences in colour and size may occur. Colours on a screen may differ from reality. Obvious mistakes or errors in the offer do not bind Bohemida.

Article 5. The contract

The contract is concluded at the moment the consumer places and pays for the order. Bohemida confirms the order immediately by email. Every contract is concluded subject to sufficient stock. If a product is not available, the consumer will be informed as soon as possible and the amount paid will be refunded.

Article 6. Prices

All prices are in euros and include VAT. Shipping costs are shown before the order is completed. Prices are subject to obvious printing and typesetting errors.

Article 7. Payment

The consumer pays when placing the order using one of the payment methods offered. The consumer reports any inaccuracies in payment details as soon as possible.

Article 8. Delivery

Bohemida delivers to the address provided by the consumer. Orders are delivered with due speed and no later than within 30 days, unless a different period has been agreed. If this is not possible, the consumer may dissolve the contract free of charge and will receive the amount paid back within 14 days. The risk of damage or loss lies with Bohemida until the moment of delivery.

Article 9. Right of withdrawal

The consumer can dissolve a contract for the purchase of a product within 14 days without giving a reason. The cooling off period starts on the day after receipt of the product, or of the last product if an order is delivered in parts. The consumer reports the withdrawal through the withdrawal function in the online shop, through the contact form or by email to info@bohemida.com. The model withdrawal form can also be used for this. Within 14 days of this notification the consumer returns the product.

During the cooling off period the consumer handles the product and its packaging with care. The consumer only unpacks or uses the product to the extent necessary to establish its nature, characteristics and functioning. In case of further handling, the consumer is liable for any loss in value.

Article 10. Costs and refund in case of withdrawal

The costs of returning the product are payable by the consumer. Bohemida refunds all payments received, including the standard shipping costs, within 14 days of the withdrawal. Bohemida may wait with the refund until the product has been received or the consumer shows that it has been returned. Additional costs for a more expensive delivery method than standard shipping are not refunded. The refund is made using the same payment method, unless agreed otherwise.

Article 11. Exclusion of the right of withdrawal

The right of withdrawal does not apply to products made to the consumer's specifications or that are clearly personal in nature, such as personalised products. Bohemida states this clearly before the contract is concluded.

Article 12. Conformity and warranty

Bohemida guarantees that the products comply with the contract and the specifications stated in the offer. The consumer always has the statutory rights in case of a product that does not comply with the contract. Small differences in colour and size that are inherent to handmade products are not covered by this.

Article 13. Complaints

The consumer reports complaints about the performance of the contract within a reasonable time after discovering a defect, fully and clearly described, through the contact form or by email. Bohemida responds to complaints within 14 days of receipt. If a complaint requires more time, the consumer will receive a confirmation and an indication of the period within 14 days.

Article 14. Applicable law

These terms and contracts are governed by Dutch law, insofar as this does not deprive the consumer of the protection of mandatory provisions of the law of the country where they live. The Vienna Sales Convention (CISG) does not apply.
